1. Introduction

Welcome to CivSec S.M.A.R.T. These Terms of Service ("Terms") govern your use of our website and digital services. By using our services, you agree to be bound by these Terms.

CivSec S.M.A.R.T is a trading name of CivSec Group B.V., a company registered in the Netherlands (KvK: 98032615).

2. Services

CivSec S.M.A.R.T provides digital services including:

• Smart Websites: Subscription-based website development and hosting
• Custom Applications: Bespoke web and mobile application development
• AI & Automation: AI-powered solutions and workflow automation
• UI/UX Design: User interface and user experience design services

3. Subscriptions & Payments

Subscription Services

• Subscription fees are billed monthly or annually as agreed
• Payments are due at the start of each billing period
• Subscriptions automatically renew unless cancelled
• Cancellation must be requested at least 30 days before renewal

Project-Based Work

• Project terms are defined in separate proposals or contracts
• Payment schedules vary by project scope
• Deposits may be required before work begins

4. Intellectual Property

Upon full payment:

• Custom code developed specifically for your project belongs to you
• We retain rights to general frameworks, methodologies, and reusable components
• Third-party libraries remain subject to their respective licenses
• We may showcase work in our portfolio unless otherwise agreed

5. Your Responsibilities

As a client, you agree to:

• Provide accurate information and timely feedback
• Ensure you have rights to any content you provide
• Pay invoices within the agreed timeframe
• Not use our services for illegal purposes
• Maintain security of any credentials we provide

6. Limitation of Liability

To the maximum extent permitted by Dutch law:

• Our liability is limited to the fees paid for the relevant service
• We are not liable for indirect, consequential, or incidental damages
• We do not guarantee uninterrupted or error-free service
• Force majeure events release us from obligations

7. Confidentiality

Both parties agree to keep confidential information private. This includes business strategies, technical specifications, pricing details, and any information marked as confidential.

8. Termination

• Either party may terminate with 30 days written notice
• We may terminate immediately for breach of these Terms
• Upon termination, outstanding fees become due immediately
• Data will be made available for 30 days after termination

9. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the competent courts of the Netherlands.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through our website. Continued use after changes constitutes acceptance.
